Terms of Service

By accessing or using the Ausori AI sound design service ("Service") operated by Ausori ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

• "Service" means the Ausori platform (website, API, and related features) and all associated offerings.
• "User" means any individual or entity that accepts these Terms and accesses or uses the Service.
• "Account" means the credentials (e.g., email address) used to access the Service.
• "Content" means video, audio, project data, and any other material uploaded or generated through the Service.
• "Plan" means the subscription tier (Free, Pro, Designer) selected by the User.

1. We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes, and 7 days' notice for non-material changes, via in-service notification or email.
2. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
3. If you are a consumer in the European Union, you have the right to withdraw from a contract within 14 days (EU Consumer Rights Directive 2011/83/EU).

1. You may register using supported authentication methods (e.g., Google OAuth).
2. You must be at least 13 years old to use the Service. If you are under 16 and located in the European Economic Area, you may require parental consent under the GDPR.
3. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. We may refuse registration or terminate accounts that provide false information, impersonate others, or violate applicable law.

1. The Service is provided within the scope of your selected Plan.
2. Free Plan users receive limited functionality (3 videos/month, up to 3 minutes, 720p).
3. Paid Plan details, pricing, and billing cycles are described on the pricing page and may change with advance notice.
4. AI-generated outputs (sound placements, timelines) produced through the Service belong to you, subject to these Terms. Original sound assets in the Designer archive remain the property of the respective sound designers.

You agree not to:

• Upload content that infringes third-party intellectual property, privacy, or personality rights.
• Transmit malware, spam, or illegal content.
• Disrupt or interfere with the Service (e.g., DoS attacks, unauthorized scraping).
• Resell or sublicense the Service or access the API without our prior written consent.
• Violate any applicable local, national, or international law or regulation, including the Digital Millennium Copyright Act (DMCA), EU Copyright Directive, and the Computer Fraud and Abuse Act (CFAA).

1. Paid Plans are billed through Toss Payments or other designated payment processors.
2. Subscriptions auto-renew at the end of each billing period unless cancelled.
3. You may cancel at any time; you will retain access through the end of your paid period.
4. EU Consumers: you have a 14-day right of withdrawal from the date of purchase, provided the digital service has not yet been accessed. Once delivery of a digital service has commenced with your explicit consent, the right of withdrawal may be waived.
5. US users: Refunds are at our sole discretion except where required by applicable state law (e.g., California, New York).
6. We reserve the right to offer promotional or discounted pricing, which may be subject to additional conditions.

1. We aim to provide the Service 24/7 but do not guarantee uninterrupted availability.
2. We may suspend or modify the Service for maintenance, security, or legal reasons, with reasonable prior notice where possible.
3. If we discontinue a paid Plan, we will provide a pro-rated refund for any unused prepaid period.

1. The Service, including its software, design, and content, is protected by copyright, trademark, and other intellectual property laws. All rights are reserved by the Company.
2. You may not reverse-engineer, copy, modify, or distribute the Service without our prior written consent.
3. You retain ownership of Content you upload. By uploading Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store it solely to provide and improve the Service, including training AI models on de-identified or anonymized data.

1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE EU CONSUMER RIGHTS DIRECTIVE FOR EU USERS), OUR LIABILITY IS LIMITED TO THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
3. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Some jurisdictions do not allow limitation of certain warranties, so these limitations may not apply to you.
4. Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

1. US Users: You and the Company agree to resolve disputes through binding arbitration under the JAMS Streamlined Arbitration Rules, except that either party may seek injunctive relief in court for IP infringement. CLASS ACTION WAIVER: You waive any right to participate in a class action lawsuit or class-wide arbitration.
2. EU / EEA Users: Nothing in these Terms affects your statutory rights as a consumer under EU law, including the right to bring claims before the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
3. All other users: Disputes shall be governed by the laws of the Republic of Korea, with the Seoul Central District Court as the court of first instance.

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your jurisdiction apply.
